These Terms and Conditions must be read and confirmed before any booking. They are available on our website and on request at contact@dayoutnarvik.com. By booking with us, you confirm you have read and agreed on these Terms and Conditions. The person who books a tour also confirms the agreement and disclaimer for themselves, the children they are responsible for and the rest of the group involved.

 

Our liabilities are defined according to the Norwegian legislation and law.

 

Booking and Payment:

• Our prices are in Norwegian Krone (NOK) per person , and includes taxes (VAT), coordination fees and provisions (if no other information is given).

• Reservation without an online payment will only be held for a max , of three (3) working days, after you have received the confirmation of availability booking by mail. It is your responsibility to let us know as soon as possible how you intend to pay and assure that we receive payment during this period. We accept payment by bank transfer (SWIFT) or credit card if you do not wish to pay online.

• We will send you a booking confirmation including total cost by e-mail once the bank confirms payment to us, so please be patient as this can take a few days.

• All personal data and credit card information is handled on an encrypted site, so all information provided is secure. Only Day Out Narvik will have access to your name and contact details. These will be used to inform you of major changes or cancellation of your booking and we commit to never sell those informations to third parties.

• Day Out Narvik has no control over the exchange rate that will be calculated for refunds and is not responsible for any loss incurred. Please note that Day Out Narvik does not pay any bank fees incurred for international transfers, and that such fees are deducted from the amount to be refunded.

 

Cancellation from the guest:

• If the guest cancels the booking before 7 days prior to departure, Day Out Narvik will refund them the whole amount minus transaction fee (3% of the total amount). 

• If the guest cancels between 1 to 7 days prior to departure, Day Out Narvik will refund them 50% of the amount.

• If the guest cancels later than 24 hours prior to departure, Day Out Narvik will retain the whole amount. 

Day Out Narvik has no control over the exchange rate that will be calculated for refunds and is not responsible for any loss incurred.

 

Cancellation from Day Out Narvik:

• Day Out Narvik has the right to cancel if the minimum participants is not reached. Full refund will then be given.

• Our adventures are subject to suitable weather conditions and Day Out Narvik has the possibility to cancel bookings if the weather does not seem appropriate to meet our safety requirements. If we decide to cancel an adventure, you will be offered to postpone your booking or get a full refund (minus the transaction fee of 3%).

• The guides of Day Out Narvik are the only persons able to take the decision to go or not with regards to the weather forecasts. Guests are not able to ask for a refund if they are the ones considering the weather is not good enough.

• Day Out Narvik is susceptible to adapt and / or change the schedule and location of the adventure and will not be liable for cancellations requests if it still meets the major characteristics of the adventure. Weather conditions are challenging above the arctic circle and we will adapt day to day to take you to the best possible area and climate. Remember this is also what makes each of our adventure a unique one.

 

Day Out Narvik shall not be liable for delays or cancellations caused by Force Majeure such as strike, lock out, collisions, natural disasters, war, terrorism, diseases or any conditions beyond our control.

 

Responsibility and Liability:

• Day Out Narvik accepts no responsibility or liability for matters that may occur during travelling or participating in activities delivered by us at or on the way to Day Out Narvik.

• All guests should carry their own outdoor / sport / travel insurance and are responsible for checking beforehand if the booked activity is covered by their own insurance policy.

• We accept no responsibility for late return to Narvik, under any circumstances: car breakdown, crash, punctures, sickness, accidents of any kind, delays, missed flights, ferries, buses etc. caused by bad weather, accidents, or any other issues out of our control: damages, injuries, accidents or delays beyond our control.

• It is necessary that guests release Day Out Narvik from all claims for damage or loss of personal belongings, baggage, cameras and/or equipment of any kind used, or from death and injuries.

• All activities at day and night are done at the guest’s own risk.

• Day Out Narvik guides will have access to a first aid kit on all adventures. Their instructions must be followed at all times during the adventure. Failure or disagreement to do so results in the immediate termination of this agreement, without notice and with no possible refund.

• The guests are responsible for having good suitable clothes and shoes for all weather conditions. Day Out Narvik will answer questions and give recommendations to that matter if asked for.

• All equipment supplied by Day Out Narvik that is used by you the paying guests is at your own risk, (backpacks, tripods, headlamps, bikes, e-bikes, hot food, transport, hot water, fire etc).

• Damages caused to equipment supplied by Day Out Narvik by any form of misuse implies that the item has to be replaced / fixed by user. Day Out Narvik can take care of the replacement / fixing procedure but the guest is responsible for paying the cost of replacement / fixing of damaged gear.

• The guide will use their experience to always make the safest possible tour and will offer advice on clothing, foot wear, gloves but we accept no responsibility for circumstances beyond our control such as avalanche, drowning, complete cloud cover, blizzard, frostbite, thin ice, border and road closure, hypothermia, death or any other cases caused by the conditions of extreme weather.

• By accepting these terms and conditions, you acknowledge that you are fully aware​ that many of the activities promoted or offered by Day Out Narvik are inherently dangerous activities, which involve the risk of serious injury or even death. These inherent risks may be unforeseen. You agree that by participating in any Day Out Narvik related activities you are responsible for your own safety and welfare and agree that you knowingly and voluntarily assume the full risks involved in any such activity.

• By accepting these terms of service​ you understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. You acknowledge that you may have to exercise extra care for your own person and for others around you in the face of such hazards. You further understand that there may not be rescue or medical facilities or expertise necessary to deal with injuries and damages to which you may be exposed.

• By accepting these terms and conditions​ you hereby release and hold harmless with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by negligence or otherwise, the following persons or entities, herein referred to as releases: Day Out Narvik AS and all its employees.

• All guides should be treated with respect and should not accept any form of abuse or humiliation from a guest at any time and Day Out Narvik guarantees that guests will also be treated with the same respect. Failure or disagreement to do so, results in the immediate termination of this agreement, without notice and with no possible refund.

 

Photography Policy:

• All photographies taken during our adventures might be published by Day Out Narvik. Unless differently agreed upon written request, the client acknowledges that all photographs taken during the tour can be publicly displayed and are owned by Day Out Narvik.

• You may not lease, sell or re-distribute, publish or use for any commercial or public purpose any Day Out Narvik images unless an extended license for product resale or a special license with free rights for the image was purchased.

• You are not allowed to use Day Out Narvik images in any way that places the photographer or people in the photo in a bad light or in any manner that is considered libelous, slanderous, defamatory, obscene, indecent, or illegal.

Termination:

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Services at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services.
